Defense offers alibi in 1994 killing
The defense case gets into full swing Tuesday after a break for the holiday weekend. On Thursday, Naposki's lawyer, Angelo MacDonald, spelled out a two-pronged defense: Naposki had an alibi that made it impossible for him to have shot McLaughlin, as the prosecution contends. And the more likely killer was Johnston, who MacDonald said could "charm the pants off most men" and set Naposki up as a "patsy". The defense argued that the delay in the case made a fair trial impossible because evidence was lost and witnesses no longer available. They failed to get the charges dropped but won a key concession from Superior Court Judge William Froeberg last week. Hearsay evidence regarding a phone call Naposki purportedly made at 8:52 p.m. Dec. 15, 1994, the night of the killing, would be admissable. That evening Naposki and Johnston were in Walnut at her son's soccer game. The two left at 8:20 p.m. and Johnston dropped Naposki off at his apartment in Tustin so he could get his car and leave for work — he was in charge of security at the Thunderbird, a club just 500 feet from McLaughlin's home. Naposki contends that he stopped at a Denny's in Tustin to return a page from the club manager and a since-lost phone bill put that call at 8:52. MacDonald suggested his client would have had to "turn back time" to kill McLaughlin because he could not have traveled the 12 miles to Balboa Coves in time, especially considering traffic on the first night of the Newport Beach Boat Parade. He attended Tuckahoe and Yonkers high schools before switching to Eastchester High School, where he graduated in 1984. He played linebacker and running back for the Eagles and then played for the University of Connecticut. Undrafted, he made the New England Patriots after a free-agent workout and played three games in 1988 before an injury cut short his season. He played briefly for the Indianapolis Colts the following year before getting injured again. He then played two seasons with the Barcelona Dragons in the World League. One of them, Dave Matthews of New York, attended the first week of the trial and will be back again Tuesday. He said there was always a sense that the police had botched the investigation when they focused on Naposki early on. Truck Collision Kills San Diego Local Woman
A 48-year-old woman, who was the passenger in a smaller Mitsubishi was killed after the car she was in crashed into a truck Sunday morning. The woman was a San Diego native, and reports show that she was wearing a seat belt in the front passenger seat. The truck accident occurred in Pala at almost 7am on state Route 76, just east of Lilac Road.
San Diego police state that the victim’s husband was driving the car west on the 76 highway when he crashed into a pickup that was turning into Pala Raceway. The San Diego Medical Examiner’s Office pronounced the victim dead at the scene after numerous failed attempts at reviving her. The woman’s name has not been released, and her husband was take to a nearby hospital with unknown injuries.
